These Terms of Service ("Terms") govern your use of the FOMO mobile application, website, and related services (the "Service") operated by Sandstone Cloud, LLC ("Sandstone Cloud," "we," "us," or "our").
By creating an account or using FOMO, you agree to these Terms. If you don't agree, don't use the Service.
You must be at least 18 years old to use FOMO. By creating an account, you confirm that you are 18 or older. We verify age during registration and may terminate accounts that do not meet this requirement.
You must provide accurate information during signup. One person per account. You are responsible for keeping your login credentials secure.
You can create an account using Apple Sign-In, Google Sign-In, email and password, or phone number. Regardless of how you sign up, you are responsible for all activity that occurs under your account.
We limit accounts to a maximum of 3 per device to prevent abuse. Attempting to circumvent this limit may result in account suspension.
You can delete your account at any time from Profile → Settings → Delete Account. Deletion is immediate and permanent.
FOMO lets you discover what's happening in real time — check in at venues, share the vibe, see where people are going tonight, find deals, and follow your favorite spots. You can:

We use automated systems (velocity checks, device fingerprinting, IP analysis) and manual review to enforce these rules. Banned users have all associated identifiers (device, email, phone) blocked from creating new accounts.
You own the content you post on FOMO (photos, videos, text). By posting, you grant Sandstone Cloud a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content within the Service. This license ends when you delete your content or your account.
Scene posts and chat messages are automatically deleted after 7 days. This is by design — FOMO is about what's happening now, not a permanent record.
We may remove content that violates these Terms without notice. Repeated violations will result in account termination.
FOMO displays venue data from third-party sources (Google Places, besttime.app) combined with user-generated check-ins and vibes. We do our best to keep this information accurate, but we do not guarantee:
FOMO is a discovery tool, not a guarantee. Use your judgment.
Venue owners can claim their venue and access a management dashboard. Venue accounts are subject to verification. By claiming a venue, you represent that you have authority to act on behalf of that business.
Paid venue tiers (Pro and Premium) are billed monthly through Stripe. Subscription terms, pricing, and cancellation policies are presented at checkout. Venue subscriptions are B2B transactions processed through our web dashboard — not through the App Store or Google Play.
By entering your phone number and tapping "Send Code," you consent to receive automated SMS text messages from Sandstone Cloud, LLC (FOMO) for account verification purposes.
Message frequency varies. Typically one message per verification attempt. No recurring or marketing messages.
Opt-out: Reply STOP to unsubscribe. Consent is not required to use the app — you can still sign in with email, Apple Sign-In, or Google Sign-In.

FOMO, the FOMO logo, Scout the Fox, and all associated branding, designs, and software are the property of Sandstone Cloud, LLC or its licensors. You may not copy, modify, distribute, or create derivative works from any part of the Service without written permission.
With your permission, FOMO sends push notifications for event reminders, deal alerts, streak updates, and other activity. You can disable notifications at any time in your device settings or within the app's notification preferences.
Your privacy matters to us. Our Privacy Policy explains what we collect, how we use it, and your rights. By using FOMO, you agree to our Privacy Policy.
FOMO is provided "as is" and "as available." We make no warranties, express or implied, regarding the Service's reliability, accuracy, availability, or fitness for any particular purpose.
We are not responsible for:
To the maximum extent permitted by law, Sandstone Cloud, LLC and its founders, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or personal injury.
Our total liability for any claim related to the Service will not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
You agree to indemnify and hold harmless Sandstone Cloud, LLC from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.
We may suspend or terminate your account at any time for violation of these Terms, with or without notice. You may delete your account at any time. Upon termination, your right to use the Service ends immediately. Provisions that by their nature should survive termination (disclaimers, liability limits, indemnification) will survive.
We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email at least 14 days before the changes take effect. Continued use of FOMO after changes constitutes acceptance.
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Virginia.
